Would you like to benefit from whistleblower status?

The “Whistleblower” system is reserved for  private individuals who report or disclose, without direct financial compensation and in good faith, information concerning practices relating to cartels (including on a public market), abuse of a dominant position, state aid.

When the information was not obtained in the course of your professional activities, you must have had personal knowledge of it.

The alert must relate to events that have occurred or for which there is a high probability that they will occur.

Whistleblowers are protected against reprisals, particularly professional ones. They also benefit from the regime of criminal irresponsibility in the event that the report resulted in the violation of a protected secret as well as the regime of civil irresponsibility for damage caused as a result of their report.

Their identity is kept strictly confidential: non-compliance with the obligation of confidentiality of their identity is punishable by criminal law, as is the act of obstructing the report, in any way whatsoever.

About the “whistleblower” system

The system was put in place by Decree No. 2022-1284 of October 3, 2022 relating to the procedures for collecting and processing reports issued by whistleblowers.

As part of processing an alert, the Autorité de la concurrence may ask you for any information it deems necessary to assess the accuracy of the allegations made.
